General Terms and Conditions

1. scope of application

These General Terms and Conditions apply to all offers and services of LABO AG as well as to orders for vouchers and products placed by customers residing in Switzerland or Europe via the online store www.labospa.ch, by telephone, e-mail or directly on site.

2. offer and conclusion of contract

2.1 Offers and services
2.1.1 It is recommended to book appointments in advance. LABO AG reserves the right to change this reservation in consultation with the customer in the event of illness of a therapist or technical problems.
2.1.2 Appointment cancellations must be communicated at least 24 hours in advance. Treatment costs will be charged for appointments that are not canceled or not attended in due time.
2.1.3 Complaints about a treatment do not entitle the client to withhold payment.

2.2 Online orders (vouchers, products)
2.2.1 The presentation of offers, services and products on www.labospa.ch does not constitute a legally binding offer, but an invitation to the customer to place a binding order (offer to conclude a contract).
2.2.2 By clicking on the commands [Order/Add to cart/Book appointment], the customer places a binding order for the services, vouchers or products listed on the order page.
2.2.3 Immediately after receipt of the order, LABO AG shall confirm receipt of the order by e-mail. The purchase contract is only concluded when LABO AG confirms the dispatch of the goods by e-mail (order or dispatch confirmation) or at the latest by delivery of the goods.

3. vouchers - validity

3.1. Validity: Vouchers are valid for 1 year (see date and period of validity on the voucher). After this period has expired, LABO AG is no longer obliged to accept the voucher.
3.2 As a voucher can be passed on or given as a gift, LABO AG is under no obligation and has no possibility to check the right of ownership of the redeemer. When a voucher is redeemed, it is only checked whether the corresponding EAN code/voucher number has actually been released by the system and whether the corresponding voucher has actually been paid for.
Lost vouchers will not be replaced.
3.3 Vouchers cannot be returned for cash value. If the value of the voucher is more than the service consumed, LABO AG is prepared to offset the remaining voucher balance in full against further visits or product purchases. In such a case, there is no entitlement to a residual payment of the outstanding voucher amount. LABO AG is not obliged to accept unpaid vouchers as a means of payment.
3.4 For operational reasons, the services listed in the voucher can only be provided or guaranteed by the company if a corresponding and timely reservation has been made or, in the case of a product purchase, the products have been pre-ordered or are in stock.
The service described in the voucher may vary slightly depending on the circumstances, but must not represent a relevant reduction in value for the guest. This can also be exchanged for a service of equal value or credited towards another service/product purchase that is not of equal value (in this case, the customer pays the price difference or retains the residual value on the voucher).
Should LABO AG have to cease its business activities for any reason, the vouchers shall expire without compensation. This is also the case if the business changes ownership. In such a case, LABO AG cannot be held liable as the original issuer of the vouchers.

4. prices and shipping costs

4.1 Prices
All offers and prices on the website are non-binding and without guarantee. Errors or changes to the goods and prices are reserved.
The prices stated on the product page include VAT and other price components and are quoted in Swiss francs (CHF).

4.2 Shipping costs
In addition to the prices stated, shipping costs may apply depending on the delivery address, quantity of goods and item. The exact shipping costs are displayed to the customer during the ordering process.

Shipping costs for vouchers:

  • Up to 2 vouchers - flat-rate shipping costs Switzerland CHF 5.00 / Europe CHF 10.00
  • From 3 vouchers - flat-rate shipping costs Switzerland CHF 10.00 / Europe CHF 20.00

Shipping costs for products (only available within Switzerland):

  • The shipping costs are a flat rate of CHF 5.00, regardless of the order quantity or order value.

5. terms of delivery

5.1 Vouchers are delivered to delivery addresses within Switzerland and Europe. Products are only delivered within Switzerland. Benefit and risk are transferred to the customer when the products are handed over to Swiss Post.

5.2 LABO AG sends the ordered products by Swiss Post (A Mail) within 1-3 working days.
Orders for vouchers that reach us before 11:30 a.m. on weekdays will be processed on the same day.
Delivery is delayed over the weekend and public holidays.

5.3 The products offered are usually in stock so that we can deliver them promptly. Should there be a delay in delivery, we will inform you immediately by e-mail.

6. returns

6.1 Please check the contents immediately upon receipt of the delivery to ensure that they match your order and are correct. Returns are only possible for damaged, defective or incorrectly delivered products. Opened sealed products cannot be returned.

6.2 To initiate a return, please contact us within 14 days of receiving your order at info@labospa.ch

6.3 Returns must be sent to the following address: LABO AG, E-Shop, Talacker 41, 8001 Zurich. Return costs shall be borne by the customer, unless the product is damaged or incorrectly delivered.

6.4 After receipt of the returned goods and their inspection, the purchase price already paid will be refunded to the customer immediately or the product will be replaced and reshipped.

7. terms of payment

7.1 Payment for the ordered items is made by credit card VISA, Mastercard or TWINT. Purchase on account is only possible by e-mail under special conditions. info@labospa.ch

8. default in payment / reminder / debt collection

8.1 Invoices are due for payment within 20 days of delivery. In the event of late payment with regard to earlier invoices, LABO AG may reject service reservations or orders received without giving reasons.
8.2 LABO AG shall send the customer 3 written reminders in the event of default. The following fees shall become due with the reminder of the claim:
1st reminder after approx. 30 days (CHF 10.- fee)
2nd reminder after approx. 60 days (CHF 20.- fee)
8.3 After expiry of the 2nd reminder period, LABO AG reserves the right to take legal action.

9. reservation of title

The goods shall remain the property of LABO AG until full payment has been made.

10. data protection

LABO AG undertakes to comply with data protection regulations when processing customer data. Further information on the handling of customer data can be found in the separate privacy policy.

11. severability clause

The invalidity of one or more provisions of these GTC shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provision.

Shipping

We offer a straightforward and cost-effective shipping service for all your purchases:

  • Shipping Cost: A flat rate of CHF 5 applies to all orders, regardless of size or value.
  • Delivery Time: Your order will be delivered within 1-3 business days via Swiss Post.

Return Policy

Below are the terms and conditions for returning items purchased from our online store.

You have the right to return products within 14 days of receiving your order, provided the items meet the return conditions outlined below.

2. conditions for returns

To be eligible for a return, please ensure that:

  • The products are damaged, defective or not matching the order confirmation. Returns for reasons other than damage, defect or incorrect items (e.g., change of mind) are not accepted.
  • The products must be unopened, unused, unworn, and in their original undamaged packaging with all tags attached.

4. return process

  1. Initiate a Return: Contact us at info@labospa.ch within 14 days of receiving your order to request a return authorization. Please provide:
    • Your order number (found on your confirmation email).
    • The reason for the return.
    • Whether you prefer a replacement or a refund for the damaged product.
  2. Pack the Items: Securely pack the items in their original packaging, including all labels and any documentation received with the product, and return them in the original shipping box.
  3. Shipping: Send the return package to LABO AG, E-Shop, Talacker 41, 8001 Zurich. Please note that return shipping costs are the responsibility of the customer unless the product is damaged or incorrect.

5. refunds

  • Upon receiving your returned items, we will inspect them to ensure they meet the return conditions.
  • If approved, we will either replace and resend the product or issue a refund to your original payment method within 5 business days.
  • Shipping fees are non-refundable unless the product is incorrect.

6. exchange policy

We do not offer direct exchanges. If you wish to exchange an item, please follow the return process and place a new order for the desired item.
